Prop 8 Overturned
A federal judge has overturned California's voter-approved ban on gay marriage, saying it violates the due process clause and equal-protection clause.
Judge Vaughn Walker wrote that Prop. 8 "fails to advance any rational basis in singling out gay men and lesbians for denial of a marriage license." You can read the decision here.
The case, which was the first federal test of a state law outlawing gay marriage, will be almost certainly be appealed to the Ninth Circuit Court of Appeals. Most court-watchers think it will eventually end up in the Supreme Court.
